Thinking Pinoy Reveals Possible Situations if Pres. Duterte Vetoes ABS-CBN's Franchise Bill


Veteran blogger and prominent social media personality Thinking Pinoy who has a huge following on Facebook revealed some possible situations if Pres. Rody Duterte vetoes the controversial ABS-CBN's Franchise Bill.


According to TP or RJ Nieto, if Pres. Duterte vetoes the bill, then Congress will have to override the veto by a two-thirds vote with each House voting separately.



Two-thirds means around 200 of 300 solons of the House and another two-third (16 of 23 senators) of the Senate is needed to override the President's veto.

The veteran blogger also list down some senators who may find it difficult to approve the proposal such as Sen. Pacquiao, Sen. Zubiri, Sen. Dela Rosa, Sen. Bong Go, Sen. Pimentel and Sen. Tolentino.

WHAT IF THE PRESIDENT VETOES ABS-CBN'S FRANCHISE BILL?

Suppose both versions of the ABS-CBN Franchise Law somehow hurdled the House of Representatives of the Philippines and the Senate of the Philippines. Assume further that the Congressional Bicameral Committee harmonized these two and sent the final version to Pres. Rody Duterte for signing.

What if PRRD vetoes it?



If that happens, then Congress will have to override the veto by a two-thirds vote with each House voting separately.

That is, two-thirds (around 200 of 300 solons) of the House and another two-thirds (16 of 23 senators) of the Senate is needed to override the President’s veto. Senator Leila de Lima won't take part because she's in detention.

That, again, is problematic.

First, the 200 votes needed in the House of Representatives is difficult in itself, and will likely require massive shepherding by the House Leadership. If so, will the House Speaker openly defy the President's decision to veto the franchise?

Second, the 16 votes needed in the Senate means if there are (23-16) +1 = 8 senators who will vote against a veto override, then the vetoed bill fails to become law.

With the resounding defeat of the political opposition in the 2019 Senatorial Elections, the Senate today is chock full of administration allies.



While some allies may still vote in favor of the franchise law during the legislation stage, a vote to override a presidential veto is a totally different banana because it openly defies the will of the President.

That is, while some may vote "yes" to the Senate Bill, it'll be exponentially harder to vote "yes" on whether the Senate should override PRRD's veto.

Let’s list down some senators who may find it difficult to approve the proposal.

PDP Laban Senators:

1. Sen. Manny Pacquiao
2. Sen. Migz Zubiri
3. Sen. Ronald "Bato" Dela Rosa
4. Sen. Bong Go
5. Senator Koko Pimentel
6. Sen. Francis Tolentino

Then there are senators who may have serious personal-political issues vs ABS-CBN:

7. Sen. Nancy Binay (UNA)
8. Sen. Ramon Bong Revilla, Jr. (Lakas)
9. Sen. Imee Marcos (Nacionalista)



Then there are the first-termer senators who may run for reelection in 2022 and may be unwilling to risk the anger of the electorate:

10. Sen. Dick Gordon (VNP),
11. Sen. Ping Lacson (Ind),
12. Sen. Joel Villanueva (CIBAC)
13. Senator Win Gatchalian (NPC)

Then there are other administration allies like:

14. Sen. Cynthia A. Villar
15. Sen. Sonny Angara
16. Sen. Vicente Tito Sotto

Among these 16, ONLY EIGHT need to reject a veto override.

That is, overriding a prospective presidential veto on the ABS-CBN Franchise Law will be really, really tough.
