Pres. Duterte Threatens to Suspend "Writ of Habeas Corpus" Over Water Issue

One of the country's most popular social media blogger, Thinking Pinoy wrote an article regarding the threat of President Rody Duterte to suspend the "Writ of Habeas Corpus" due to the controversial problems involving the 'onerous' contract signed by the Philippine government and the two largest water concessionaires.


According to Thinking Pinoy who based his reports in the article published by ABS-CBN titled "If Unsatisfied, 'Duterte says to take 'everything' from Manila water, Maynilad" published on December 10, 2019.



The article says that President Rody Duterte summoned officials of the Metropolitan Waterworks and Sewerage System to the Palace and the lawyers who crafted the 1997 water concession deals.

The President warned of suspending the writ of habeas corpus should MWSS officials and lawyers responsible for the agreements fail to heed his order.

Pres. Duterte was quoted as saying "Yung mga abugado noon kung ayaw nilang pumunta rito, I will drag them. Then if you will force my hand, I will throw my last card. Ayaw ninyo? O sige. I will suspend the habeas corpus at hilain kayo. Widespread economic sabotage," he said.

"Ayaw ninyong pumunta dito? Gusto ko magharap silang lahat dito sa akin. Isa-isahin ko sila, ang abugado ng p*t*ng*n* gumawa ng kontrata. Sino ’yung mga opisyal ng MWSS? Tanungin ko sila, what the f*ck did you do and screwed the country?" he added.



Based upon the Philippine Constitution's definition of "Writ of Habeass Corpus," it is a law stating that an individual cannot be imprisoned or held in custody inside a prison cell unless he/she has first been brought before a court of law, which decides whether or not it is legal for the person to be kept in prison.

The suspension of writ of habeas corpus on the hand will only mean that the government can arrest or imprison any individual even without decision from any court. The writ of habeas corpus may be suspended in order to prevent any violence in cases of rebellion or insurrection.

The 1987 Philippine Constitution, Article III, Section 15 provides that "The privilege of the writ of habeas corpus shall not be suspended EXCEPT in cases of invasion or rebellion, whent the public safety requires it."
