Lawyer Lectures Carpio for BBM Disqualification Issues Due to Tax Evasion

A veteran lawyer and prominent suppporter of former Senator Bongbong Marcos lectured the controversial statement released earlier by former Associate Chief Justice Antonio Carpio regarding the tax evasion case of Marcos. 


After the controversial Oxford University diploma issue failed, according to some netizens the Dilawans are showing their true color of desperation as they brought another issue, this time around a possible disqualification case against BBM due to the tax evasion case. 

Presidential aspirant Bongbong Marcos is now on the situation that fits him with the popular Filipino saying that says "Pag ang puno ay hitik sa bunga, binabato."


The former Senator who is now considered as the frontrunner to be the next President of the Republic is being attacked left and right, front and center by supporters of his rivals, some presidential rivals even used an old as well as rehashed issues against the son of former President Ferdinand Marcos. 

Due to the recent failures of the issues brought about by the Dilawans, the failed Oxford University special diploma controversy, here comes another issue raised by former Justice Carpio, which was immediately picked up by the Dilawans supporters particularly the mainstream media. 

Justice Carpio claimed that BBM might be disqualified for failing to file income taxes from 1982-1985. However, the issues raised by Carpio was questioned by veteran lawyer, Atty. Trixie Cruz-Angeles. 

Citing the Omnibus Election code, Atty. Angeles defended BBM and lectured Justice Carpio by arguing that an individual can only be disqualified for 5 years if he was convicted of a crime involving moral turpitude.

Sabi ni Justice Carpio maaaring ma disqualify daw si BBM dahil hindi ito nag file ng income taxes nuong 1982-1985.

Hindi kami sangayaon.

Ayon sa Omnibus Election Code madidisqualify ng limang taon ang isang kandidato sa eleksyon kapag ito ay nahatulan ng parusang higit sa 18 months o na convict sa isang krimen na may moral turpitude.

Ang ibig sabihin ng moral turpitude ay yung krimen na sobrang sama (“an act of baseness, vileness or depravity”).

Dahil mismong Supreme Court ang nagsabing napalawal ng depinisyon ng moral turpitude, ina-identify nito ang mga specific crimes na may ganun tulad ng graft, libel, rape, abduction, concubinage, bigamy, robbery, murder, theft, perjury, fencing, forgery, intriguing against honor, at iba pa.



Di po kasama dito ang failure to pay taxes.

Ayon kay Justice Carpio, maaaring gawing argumento na masama nga ang ilang beses na di nag file ng income taxes. Kaya niya sinasabi yun, ay dahil sa ngayon, walang batas o juriprudence na nagsasabing may moral iyon. Kaya “a cse can be made for…” that lang.

Tila nagpapahiwatig si Dating Justice Carpio, na pwede pang kasuhan ng disqualification si BBM.

Eto ang problema. Matagal na po yung kaso. Matagal nang nahatulan at ilang beses nang tumakbo si BBM sa ibat ibang posisyon sa gobyerno. Tapos ngayon nila kakasuhan kung kelan malakas at may pagkakataong manalo sa halalan? Di naman kaya masyadong halata?
