The Department of Justice (DOJ) finds probable cause to charge former Health Secretary Janette Garin and nine other DOH Officials for violation of Article 365, in relation to Article 49 of the Revised Penal Code.
The DOJ charge Garin and company with recless imprudence resulting to homicide over the controversial Dengvaxia mess implemented during the administration of former Pres. Noynoy Aquino.
According to the DOJ panel they found Garin and other respondents to have exhibited an "inexcusable lack of precaustion and foresight when they facilitated, with undue haste, the registration and purchase of Dengvaxia and used the vaccine in implementing a school-based dengue mass immunization program."
The controversial Dengvaxia vaccine was administered to over 800,000 students in a school-based government immunization program in April 2016. Sanofi Pasteur in November 2017, announced the vaccine posed potentially severe dengue risks among those with no dengue history.
The resulting panic from the revelations of the drug's manufacturer prompted the Department of Health to suspend its program.
In a statement on Friday, the DOJ said state prosecutors found Garin and the other respondents to have "exhibited 'inexcusable lack of precaution and foresight' when they facilitated, with undue haste, 'the registration and purchase of Dengvaxia' and used the vaccine in implementing a school-based dengue mass immunization program."
The prosecutors also found cause to charge nine other officials from the Department of Health, two from the Food and Drug Administration, two from the Research Institute for Tropical Medicine, and six from vaccine maker Sanofi Pasteur for the same offense.
