Veteran San Beda Lawyer and prominent defender of Pres. Rody  Duterte on social media, Atty. Bruce V. Rivera lectured Senators Tito Sotto and Sen. Ping Lacson on the reasons why the National ID or PhilSys Law (RA 11055) could not help the fight against COVID-19.


During the past few days the two lawmakers blames the non-implementation of the National ID as one of the reason why the government found it hard to do the contact tracing of COVID-19 affected patients and the people who they've meet during the time when patients were not tested yet.



Atty. Rivera made some research and found out some problems with the National ID System implementation despite the fact that it was signed by Pres. Rody Duterte last August 2018 bbut the roll-off of the system will be made available on July 2020.

According to the veteran lawyer, during the entire 2019 the Philippine Statistics Authority, the head implementing agency already coordinated with various departments like the National Privacy Commission, NEDA and other agencies.

The senators who blames the national government for the non-implementations of the National ID knew for sure that there is no budget yet for the Philippine Statistics Authority (PSA) for the year 2019. The hiring of personnel for the National ID started last February 2020 because the PSA is not a large agency to handle such endeavor.

NATIONAL ID: BAKIT HINDI NAIMPLEMENT PARA MAKATULONG SA PANDEMIC

Naalala ko na sinisi ni SP Sotto at Sen. Lacson kung bakit hindi pa naimplement ang National ID or PhilSys Law (Republic Act 11055) kahit August 2018 pa nila ito pinasa. Napadali sana ang contact tracing at pagbigay ng ayuda. At first, napaisip ako, oo nga ano. Bakit nga ba?

Then the researcher in me went to work. At mapamura ako kasi napalaking echus. Let me explain.

Kung babasahin mo ang batas, may mga periods nga silang nilagay pero ang head na implementing agency ay Philippine Statistics Authority or PSA na kasama ang ibang departments katulad ng National Privacy Commission, NEDA, etc. At alam ng mga Senators na ito ang timeline ng pag-isyu ng ID.

Alam nila na July 2020 pa ang start ng roll-off ng sistema kasi buong 2019, the PSA already said it will have to coordinate with all the agencies on the security features and comply with privacy issues of the citizens. At alam din siguro nila na wala naman silang budget na nirelease for the implemantation kasi dapat ay Feb. 2020 pa ang paghire ng mga taong magiging part ng team kasi the PSA is not a large agency to handle such endeavor. (First problem sa batas.) In short, alam ng Senate na July 2020 pa ang National ID magsisimula at matatapos ito before the end of the term of PRD kasi nga 107 million Filipinos plus resident aliens.



Importanteng tanong: halimbawa kung natapos natin ang National ID before tayo binastos ng CoVid, makakatulong ba ang isang National ID sa contact tracing?

Ayon sa batas, ang telephone number, mobile number or email add ay OPTIONAL. So walang obligation ang isang Pinoy na ibigay ang mobile number at kung magbigay man tapos binago, walang obligation na irectify ang entries kasi optional nga. (Second problem sa batas)

Ayun din sa batas, hindi mandatory na ipresent mo ang National ID when you purchase an airline ticket or any local travel tickets. So kung hindi ka required, pwede kang gumamit ng ibang ID at dahil hindi mandatory, ang isang airline na gusto kumita will not require the National ID. Kahit ID sa spa, pasok. At madaling gumawa ng ID na peke na walang biometrics.(Third problem sa batas)

Hindi din naman required ang mga credit card transactions na lalabas sa biometrics ng National ID kasi violation ng right to privacy yan. So, even with the National ID, contact tracing will still be as difficult because the National ID can only be used to confirm or give a yes or no answer to the identity of the person based on the details in the card.

Sa importanteng tanong na makakatulong ba ito sa pagbigay ng ayuda?

Sinabi ng batas na magagamit mo ang card to apply for passports, pay taxes, apply for loans, and apply for government services however, it will only establish identity pero hindi ibig sabihin ay qualified ka na sa mga benefits. So, kung member ka ng 4P's tapos may ID ka na bigay ng DSWD, maari mong gamitin ang National ID kung nawala ang id na binigay sa yo ng DSWD.



Eh paano sa LGU, makakatulong ba ang pagkakaroon ng National ID? Ito ang tanong, paano ka ba naging constituent ng isang LGU? Dahil ba botante ka duon, tumira ka duon or nagbabayad ka ng tax duon? Ano ang sinabi ng batas? Hindi klaro. (Fourth problem sa batas)

Kasi po, hindi kasama ang COMELEC sa batas. Ibig sabihin, may sariling lista ang COMELEC at hindi ito kailangan coordinated sa National ID. So may sarili pa ding mundo ang voters list. Ang basehan lang ng LGU ay kung ano ang sasabihin ng tao na address niya. At dalawa ito ha, permanent residence at present residence. So may chance ang isang Pinoy ay lalabas sa dalawang masterlist ng LGU.

Kaya ayan. Maganda pa din ang batas kasi kahit papano may registry tayo ng mga bagay na kailanganin natin if we decide to use the ID. And ang mga problema can be tweaked later on. Pero, huwag naman sana tayong magpabibo sa mga batas na ginawa kung hindi naman sure sa nagagawa nito.

Again, in the time of the pandemic, silence is gold.
