Judge Andres Soriano Says Trillanes Coup d'etat Case Now Considered Submitted for Resolution (Photos)
Makati City RTC Branch 148 Presiding Judge Andres Soriano is set to release a decision on Trillanes' case anytime from now after the judge now considered the case of Trillanes submitted for resolution.
According to Makati RTC Branch 148 they will be resolving the DOJ's request to issue an arrest warrant against controversial lawmaker, Sen. Antonio Trillanes IV over his coup d'etat charges during the administration of former Pres. Gloria Macapagal Arroyo.
In an order released to the media dated October 11, 2018, RTC Branch 148 Presiding Judge Andres Soriano said that the court has submitted most of the documentary evidence filed by the camp of Trillanes and the DOJ, and they will be issuing a decision soon.
"[T]he factual issues as specified in the order dated September 28, 2018, and the issue on the 'legality' of Proclamation No. 572, series of 2018 based on the pleadings/motions filed by the parties – as they may bear upon the prosecution's urgent ex-parte motion… – are now considered submitted for resolution," Soriano said.
The court handling the second case of Trillanes admitted his certificate of amnesty, sworn statements, a photograph of the senator applying for amnesy and copies of the DND memorandum circulars.
However printouts of the official FB page of DND and a "throwback" photo of Trillanes were rejected by the court as these were never identified by any defense witness during the October 5 hearing.
Judge Soriano on his decision to submit the case for resolution noted that the Certificate of Amnesty of Trillanes was never identified by any of the defense witnesses and the original copy in the possession of Trillanes was never presented for comparison with the certified copy.
The RTC Branch 148 Presiding Judge also stated that with respect to the objection on Exhibit "4-E" pertaining to the printed photograph of the application for amnesty of Trillanes for the reason that it is no duly athenticated, the same is noted. Nevertheless, the Court admits the exhibit as part of the testimony/Affidavit of Rull, without prejudice tot he dtermination of the probative value in due course.
