Popular social media personality and a well-known Pro-Duterte supporter with more than 1 million followers on Facebook, Thinking Pinoy, made another interesting expose on how Chief Justice Maria Lourdes Sereno Dug Her Grave in Advance.


Thinking Pinoy reminded CJ Sereno that during the time when she was still an associate justice of the Supreme Court, she wrote a dissenting opinion on PSBank vs. Senate of the Philippine Impeachment Court.

In the said dissent Sereno wrote, "Even prior to the 1987 and the 1973 Constitution, our laws have already imposed the obligation to disclose ownership of properties and assets."



The controversial Chief Justice added further that "Thus, as early as 1960, R.A. 3019, otherwise known as the Anti-Graft and Corrupt Practices Act, was promulgated, requiring from every public officer a detailed and sworn statement of their assets and liabilities.

"Under this law, failure to comply is prima facie evidence of unexplained wealth, which may result in the dismissal from service of the public officer..," Sereno wrote.

In order to complete her point, CJ Sereno cited in the dissenting opinion two sections of RA 3019, one of which involves the requirement for public officials to file a SWORN SALN at the start of each year, with the SALN covering the year immediately preceding the date of filing.

Due to the alleged failure of CJ Sereno to file her SALN, Thinking Pinoy suggests that the Chief Justice already dug up her own grave six years in advance.

CJ SERENO DUG HER GRAVE IN ADVANCE?

Chief Justice Lourdes Sereno, then an associate justice of the Supreme Court of the Philippines, wrote a dissenting opinion on PSBank vs Senate of the Philippines Impeachment Court (GR No 200238).

In that dissent, Sereno wrote, "Even prior to the 1987 and the 1973 Constitution, our laws have already imposed the obligation to disclose ownership of properties and assets."

Sereno added, "Thus, as early as 1960, R.A. 3019, otherwise known as the Anti-Graft and Corrupt Practices Act, was promulgated, requiring from every public officer a detailed and sworn statement of their assets and liabilities.

In light of her own declaration against interest, it must be recalled that Sereno filed her 2006 SALN four years late in 2010, as the stamp on the said document shows UP Diliman received it only in July 2010. To make matters worse, the SALN was not even notarized.

This shows that Sereno failed to comply with RA 3019 on two grounds:

1. That she filed her SALN four years late, in violation of the requirement that SALNs covering a given year should be filed RIGHT AFTER that year ends.

2. That she filed an unnotarized SALN, i.e. she DID NOT SWEAR to its truthfulness, i.e. it is NOT A SWORN SALN, which is required by RA 3019.

Again, what did Sereno say in 2012? That's a rhetorical question.

With these said, I think the SC en banc can simply focus on the 2006 SALN, as it's as clear as day that Sereno indeed failed to sufficiently comply with SALN regulations on that particular document, i.e. she failed to comply with RA 3019.

And what did she say about non-compliance with RA 3019? That's another rhetorical question.

Simply put, Sereno FAILED to file her SALN in 2006.

Given these, Sereno COULD NOT HAVE BEEN ABLE TO COMPLY with JBC's 2012 10-year SALN requirement for the simple reason that her filing of her 2006 SALN is INVALID, i.e. there's no SALN to submit in the first place because the 2006 SALN, given what has been discussed, is NON-EXISTENT.
