Prominent Lawyer Lectures VP Leni Robredo the Constitutional Provisions on Martial Law


A Prominent lawyer who graduated from the University of the Philippines (UP), Atty. Trixie Cruz-Angeles lectured the Vice President of the Philippines, VP Leni Robredo, on the Constitutional Provisions of Martial Law after the Supreme Court uphold Pres. Duterte's decision to declare Martial Law in Mindanao.


According to Atty. Trixie-Cruz Angeles the Vice President has once again revealed that she has not carefully read the constitutional provisions on Martial Law.

Vice Pres. Leni Robredo released an official statement yesterday, July 4, 2017 wherein she said that Congress MUST review Proclamation 216 on behalf of the people, insinuating that despite the Supreme Court's ruling on the factual bases of the declaration of martial law, Congress still has the obligation to make a review.

Atty. Trixie Cruz-Angeles debunked VP Leni's claim by stating that "Incorrect. It is not mandatory on the part of Congress to review the declaration. In fact it is not even mandatory on the part of the Supreme Court. The sole power to declare martial law lies with the president.

The Vice President has once again revealed that she has not carefully read the constitutional provisions on martial law. In a statement yesterday 04 July 2017 she said that Congress MUST review Proclamation 216 on behalf of the people, insinuating that despite the Supreme Court's ruling on the factual bases of the declaration of martial law, Congress still has the obligation to make a review. 

Incorrect. It is not mandatory on the part of Congress to review the declaration. In fact it is not even mandatory on the part of the Supreme Court. The sole power to declare martial law lies with the president. And while the power of review for purposes of revoking it, is indeed on Congress, it is not duty bound to do so.

Besides, they already did. And act presumed when they refused to convene to discuss the declaration.
