Administrative Complaints Filed Against Overall Deputy Ombudsman Melchor Carandang


One of the country's most prominent lawyer, Atty. Glenn Chong revealed on his official Facebook Page that an administrative complaints was already filed against Overall Deputy Ombudsman Melchor Carandang.


Two separate administrative complaints were filed against the controversial ODO Carandang, an appointee of former Pres. Noynoy Aquino, by a total of four lawyers.

The first complaint against Carandang was filed by former Congressman Jing Paras due to grave misconduct, gross dishonesty and gross negligence constituting betrayal of public trust, violations of Section 3 (e) and (k) of R.A. No. 3019 or Anti-Graft and Corrupt Practices Act and violations of Section 3(f) (ii), Rule IV of Implementing Rules of R.A. No. 6713 or the Code of Conduct and Ethical Standards of Public Officials and Employees allegedly committed by Carandang.

According to the Philippine Constitution, the only way to suspend the head of the Office of the Ombudsman is through an impeachment proceedings but all the deputies of the Ombudsman like Carandang were not given the leeway and provisions for impeachment. All deputies are under R.A. No. 6770 or the Ombudsman Act.

Based on Section 8 (2) ng R.A. No. 6770, the Deputy Ombudsman or the Special Prosecutor could be removed from office by the Philippine President if they were proven guilty of culpable violation of the Constitution, treason, bribery, graft and corruption, and other high crimes or betrayal of public trust, after due process.

The case against the Overall Deputy Ombudsman was already filed at the Office of the President and it is clear based in the Philippine Constitution that Pres. Duterte has the power to investigate and impose fines against the deputies of the Ombudsman.

Overall Deputy Ombudsman Carandang's case was filed against the official due to the facts that he allegedly spreads fake news not only in social media but also in the mainstream media.

Carandang was the one responsible for Pres. Duterte's alleged bank accounts expose, which documents allegedly came from AMLC, only to found out later that he was merely giving an information sourced from the mainstream media and not through his own research and investigation.

The controversial Carandang was also a recipient of robbery and extortion case from the Quezon City Prosecutor's Office during the year 2013.

The second and third complaint against Carandang was filed by Atty. Manuelito Luna and Atty. Eli Mallare to the Office of the President.
